The Federal High Court sitting in Osogbo, Osun State, has adjourned hearing in the case filed by reinstated All Progressives Congress (APC) Chairmen and Councillors, who are seeking judicial clarification on the duration of their tenure in office, which they claim should run until November 27, 2025.
The case, marked FHC/OS/CS/147/2025, was instituted by Onibonokuta Saheed and seven others against the Attorney General of the Federation and six others. The claimants are challenging the legality of the local government elections allegedly conducted in February 2025 by the administration of Governor Ademola Adeleke.
In their suit, the APC officials are asking the court to determine whether their three-year tenure, which they argue began in February 2025, remains valid, and whether the Osun State Independent Electoral Commission (OSIEC) had the authority to conduct another election into the same offices on February 22, 2025, while their term was still ongoing.
The case stems from the lingering Osun Local Government Administration crisis, which has generated widespread debate and multiple litigations following the Court of Appeal’s decision on February 10, 2025, reinstating the APC Chairmen and Councillors who were earlier removed from office.
During Monday’s proceedings, counsel to the claimants, Barrister Muhydeen Adeoye, filed a motion seeking to restrain the defendants from interfering with his clients’ duties until the substantive suit is decided.
However, counsels representing the Governor and the Commissioner for Justice — Barrister F. Labo-Popoola, as well as Barrister Rachael Ojomi for OSIEC and Barrister J.A. Ayanyemi for another defendant — argued that they were still within the legally permitted time to respond to the originating summons.
Justice Adefunmilola Demi-Ajayi, presiding over the matter, observed that service of court processes on all parties was yet to be completed. She therefore directed the claimants to ensure proper service before the next hearing date.
The judge, who had earlier assured that the case would be handled expeditiously, adjourned further hearing to November 27, 2025.
